Background
The Climate Protection Program (CPP) puts the health and safety of Oregon communities and local economies first. We are calling for the restoration of the CPP because it will reduce pollution from Oregon’s largest oil and gas companies and create a large community fund that will go directly to environmental justice (EJ) communities.

This powerful program can represent a meaningful win for EJ communities, especially Black, Indigenous, people of color, those with low-income or disabilities, seniors and children, and our rural and coastal communities who experience climate change first and worst. Right now, part of the Climate Protection Program that empowers and invests in EJ communities is under attack.

How did Oregon’s Climate Protection Program Start?
In 2020, Oregon took the lead in climate action by creating the Oregon Climate Action Plan. This plan led to the Climate Protection Program (CPP), which went into effect in January 2022 and set Oregon on a path to permanently limit greenhouse gas emissions. The CPP requires oil and gas companies to steadily reduce their greenhouse gas emissions by a significant 80% by 2050!

Why does the Climate Protection Program Need Your Support?
In 2023, oil and gas companies sued the state ofg Oregon and used a legal loophole to shut down the CPP. Now, the DEQ is working with diverse stakeholders to reinstate the program in 2024. Our goal is to strengthen the program and protect it against future attacks by polluters.

How do Oregonians Benefit from Climate Pollution Limits?
The CPP includes the Community Climate Investments (CCI) program, which directs funds from polluters to the communities most impacted by climate change. These funds are meant to help underserved and marginalized communities improve air quality by reducing industrial emissions, build clean energy infrastructure, prepare for climate emergencies, create jobs, and strengthen local economies.

Oregon has an amazing opportunity to protect our climate and deliver justice to frontline communities by restoring the Climate Protection Program. This program is designed to cut fossil fuel emissions by 90% by 2050 and invest $150 million annually in clean energy projects for communities hit hardest by climate damage.

However, the oil and gas industry is trying to weaken these protections. They sued to overturn the CPP, threatening the future of our climate and our communities. We need your help to ensure the CPP stays strong and on track!

What We’re Asking For

Prioritize Communities: Support a strong Community Climate Investments (CCI) program that directs resources to those experiencing the worst impacts of climate change.

No Loopholes: Oppose any new compliance options that would let oil and gas companies off the hook.

Follow the Science: Uphold the emissions cap to ensure real, near-term reductions in pollution.

An offset is a way to make up for pollution released into our environment by supporting projects that reduce pollution elsewhere. Pollution offsets involve buying and trading imaginary credits that allow corporations to pollute as long as they buy enough credits to make up for it.

Community-based organization Verde would like to expand their community solar project, which increases climate resilience and decreases utility bills for EJ communities with historically high bills. With Community Climate Investment Program (CCI) investments, Verde could reach more families across Portland.

Some people see offsets as greenwashing because it’s hard to calculate exactly how much offsetting is required to make up for the polluting action.

We must reject offsets and protect the CCI program from rollbacks. Offsets undermine public health initiatives and allow polluters to avoid making real emissions reductions.

The Community Energy Project performs deep energy efficiency retrofits in EJ communities in Portland. Funds would enable efficient direct expansion from about 60 homes per year to 200.

What is an Environmental Justice Community?

An Environmental Justice Community is a group of community members living in an area disproportionately impacted by environmental hazards, such as industrial pollution and climate-driven natural disasters. These communities often face barriers to accessing environmental benefits due to established social inequalities. We encompass diverse populations, including those from low-income, communities of color, indigenous peoples, native communities, and other marginalized community members. Our communities are at higher risk of living near pollution sources and often lack the resources to minimize environmental health risks in our own homes. The intention of Environmental Justice is to advocate for policies that ensure all communities, regardless of socioeconomic status or race, receive equal protections from environmental hazards, equitable access to environmental benefits, and meaningful involvement in decision-making processes that affect their environment.

The Oregon Department of Environmental Quality’s Plan for Re-establishment:
The Oregon Department of Environmental Quality (DEQ) has announced plans to reestablish the state’s Climate Protection Program following a Court of Appeals ruling that invalidated the rules due to a procedural technicality.

Governor Kotek’s Support:
Governor Kotek is in full support of the reinstatement of the Climate Protection Program, demonstrating a commitment to uphold Oregon’s bedrock climate policies and reach the state’s climate goals.

Swift Reinstatement and Concerns:
Beyond Toxics is a key legal intervenor in the court case and, along with a coalition of environmental justice, climate, and business organizations, emphasize the importance of swift reinstatement. Our collective goal is to address climate goals, hold fossil fuel companies accountable, and ensure economic prosperity, especially for disadvantaged communities. There are concerns about potential delays that could weaken the program’s underlying rules. We advocate for maintaining the science-based integrity of the Climate Protection Program throughout the reinstatement process.

The Climate Protection Program, adopted by the Oregon Environmental Quality Commission, left unscathed, will help secure a healthy climate future, invest in frontline communities, and hold corporate polluters accountable. This makes Oregon only the third state to require reductions in harmful greenhouse gas emissions!

The adopted program came after a robust year-and-a-half-long rulemaking process, extensive advocacy from climate and environmental justice advocates (including Beyond Toxics), and over 7,600 comments from the public!

If the fossil fuel industry is successful, this lawsuit will hinder the Oregon Department of Environmental Quality’s authority to regulate climate pollution more broadly. The Climate Protection Program is essential in achieving our state’s climate goals. It also sets a precedent for other states looking to adopt programs in the face of climate inaction. It is absolutely critical that we use every tool to defend this program against rollbacks.

Background

In December of 2021, Oregon took one of its biggest steps ever toward reducing climate pollution and delivering a stable climate for the future. Earlier that year, a consortium of fossil fuel and industrial polluter corporations filed a lawsuit to kill this precedent-setting climate action program! On September 7, 2022, a coalition of environmental justice, climate, and business organizations filed a legal intervention to defend Oregon’s landmark Climate Protection Program against attempted oil and gas industry rollbacks.

The adopted program came after a robust year-and-a-half-long rulemaking process, extensive advocacy from climate and environmental justice advocates (including Beyond Toxics), and over 7,600 comments from the public!
