There was a hearing on January 20 regarding the appeal of Benton County Board of Commissioners’ recent approval of the Coffin Butte landfill expansion. The Board of Commissioners voted unanimously to reopen the record to accept new evidence and testimony related to the proposed expansion.
New testimony can only relate to the DEQ’s Pre-enforcement letter.

Right now, Benton County Board of Commissioners is only accepting testimony related to the Oregon Department of Environmental Quality’s (DEQ) Pre-Enforcement Letter that was published on November 6, 2025.

Coffin Butte claims that 72% of its landfill is exempt from monitoring, meaning that they do not monitor nearly 3/4 of the landfill for leaks. Only Oregon DEQ can approve monitoring exemptions; they have approved no such exemptions for Coffin Butte.

EPA, DEQ, and community-led inspections of the landfill liner, which is vital to containing gas emissions, have repeatedly found and documented numerous holes that allow gas to escape unmitigated. In some instances, trees and bushes are growing out of the holes, which means that Coffin Butte has failed to address them for signifciant periods of time.

To support their expansion application, Coffin Butte Landfill conducted an odor study using two emissions modeling softwares. The outputs of these models suggested that the landfill with its expansion would only pose minor odor nuisances on the landfill itself. Each year, DEQ receives dozens of complaints from nearby residents whose daily lives are impacted by the odor of landfill gas. The results of Coffin Butte Landfill’s odor study contradict the lived experiences of residents.
DEQ recently issued a pre-enforcement notice (PEN), which is a legal document outlining violations of regulatory law that Coffin Butte could be fined for. Many of these violations found by DEQ call the odor study into serious question. Coffin Butte’s odor study is based on two EPA models that calculate the total amount of gas produced by the landfill and estimate where those gasses travel and cause odors. LANDGEM calculates the likely amount of gasses a landfill produces based on the waste in the landfill. This can be combined with the Gas Collection and Control System (GCCS), which is supposed to collect landfill gas and route it to a flare and/or energy generator for destruction. The GCCS doesn’t capture all the gas, and the remaining gas is called fugitive emissions.
Coffin Butte took its estimated fugitive emissions from this and entered it into the second model, called AERMOD. This model estimates how those fugitive emissions will move off of the landfill. Coffin Butte estimated the movement of a few gasses that are likely to cause odors in their study using AERMOD. They found that the landfill with its expansion would not cause nuisance odors despite the fact that the landfill currently causes nuisance odors without its expansion.
There are numerous flaws to call attention to in this study. These flaws help bridge the gap between what residents are experiencing and the ill-found conclusion that the landfill is not causing an odor problem. These flaws also suggest the operators of Coffin Butte either do not know how to comply with federal and state regulations, or they are actively choosing to violate them. Republic Services, the corporate owner of Coffin Butte, is the second largest waste management corporation in the United States. Republic Services is a fortune 500 company, and they operate more than 200 landfills. A company with this level of wealth, resources, and infrastructure has no excuse to not be complying with regulatory law.
There are flaws with the odor modeling tool worth considering. Modeling is not based on actual measurements of pollutants. It estimates the quantity of those pollutants and it estimates where they travel. AERMOD has several limitations worth noting.

AERMOD is not good at calculating the movement of air pollutants in low wind speed environments. All complaints filed by residents occurred in conditions of 4 mph or less, with the majority being 0 mph.

AERMOD is not good at modeling across complex terrain. Coffin Butte landfill is placed between two large hills on the edge of a valley. AERMOD relies on wind measurements taken at a higher elevation than these hills. AERMOD is not able to properly account for this complex terrain.

AERMOD is not able to model emissions in a thermal inversion, which is a very common weather pattern in the Willamette Valley during the cold months. 82% of complaints occur during the fall, winter, and spring, the seasons where inversions are common in the Willamette Valley.
DEQ has found that Coffin Butte Landfill is not complying with federal and state requirements for its Gas Collection and Control System (GCCS), and they found the monitoring—used to ensure the GCCS is capturing all the gas it should be—is inadequate, also violating the law.

Coffin Butte’s GCCS is not properly designed for a landfill of its size. The system is too small to handle the amount of gas produced by the garbage it contains.
Coffin Butte’s GCCS has been shut off for extended periods of time. For example, the GCCS was not operating for 15 total calendar days in the first quarter of 2025. GCCS should be operational 24 hours a day.

Coffin Butte’s flare has also been shut off for extended periods. While the GCCS was still collecting gas, that gas was vented straight into the atmosphere without treatment.

Coffin Butte is not monitoring an average of 72% of their landfill for leaks. Coffin Butte cited these areas as “exempt” from monitoring despite the law requiring them to get DEQ approval for exemptions. DEQ has never approved an exemption for Coffin Butte.

Independent EPA and DEQ inspectors and community members have repeatedly found and documented holes in the landfill liner, which is supposed to stop gas from escaping the landfill. Coffin Butte maintains they inspect the liner daily for holes, but other parties have found bushes and small trees growing out of the liner, which suggests holes go unaddressed for extended periods of time allowing vegetation to grow out of them.
DEQ found that Coffin Butte’s LANDGEM calculations are wrong and are under estimating the total landfill gas produced by the facility.

Pre-Enforcement Notice (PEN): Also called referred to as the “Pre-Enforcement Letter.” This is a legal document issued by Oregon Department of Environmental Quality (DEQ) which outlines violations of regulatory law that Coffin Butte could be fined for.
LANDGEM: One of the models used in the Coffin Butte odor study. This model calculates the likely amount of gasses a landfill produces based on the waste in the landfill.
Gas Collection and Control System (GCCS): A system that collects landfill gas and routes it into a flare to be burned off and/or an energy generator for destruction.

The office of Governor Kotek is developing the Plan for a Resilient Oregon (PRO), a resilience strategy to help Oregon communities prepare for and thrive in the face of increasingly severe disasters. Beyond Toxics has partnered with the State of Oregon to hold several in-person events this winter to ensure the community’s voices are reflected in the PRO.
We invite Lane County residents to participate in a short online survey (10-15 minutes) to share their ideas, experiences, and priorities for building resilience. We encourage all to participate, whether you live on the coast, a rural fire district, or an urban neighborhood.
The survey is available in both English and Spanish.

Support our coalition partners in passing the Climate Resilience Superfund Act! This is a bill patterned after similar laws in New York and Vermont that establishes a comprehensive program to assess damages and collect billions of dollars from major polluters.
Funds are collected from multinational oil and gas corporations who contributed at least a metric billion tons of carbon emissions from 1995-2024. They are allocated towards wildfire resilience, land conservation, and communities on the front line of climate change.

The Department of State Lands application for a proposed e-commerce distribution center in west Eugene has been reissued for public comment. This is an opportunity to voice your concerns and opposition to a mega-warehouse that will destroy more of the Willamette Valley’s dwindling wetlands.

To the Department of State Lands,
I/We write to express significant concern regarding the wetland fill permit application for Clear Lake E-Commerce’s proposed industrial development in West Eugene. It is imperative to reduce environmental pollution in West Eugene, an area which is exposed to an extremely disproportionate share of environmental degradation and has associated poor health outcomes.
The Department of State Lands (DSL) has the express authority to review the environmental justice impacts of a project, and subsequently require mitigation prior to the approval of a permit, or deny a permit if no meaningful mitigation measures or alternatives can be achieved.
Filling in wetlands for uses such as freight warehouses like the one proposed, have severe impacts on nearby communities. Wetlands play an integral role in improving water quality, and habitat, but they are also crucial in storing floodwaters.
Filling these wetlands and developing the proposed warehouse would add an estimated 2,592 vehicle trips per day on Highway 99, which runs through many of the most polluted neighborhoods in the City.
These e-commerce facilities are routinely being sited near environmental justice communities with higher proportions of people of color, lower-incomes, and existing health disparities.
The warehouse is within the City’s Clear Lake Overlay zone, which it enacted in-part to recognize the issue of environmental justice (EJ) and the existing public health problems faced by surrounding communities.
The DSL has the authority, and the duty to consider environmental justice in its decisionmaking.
The applicant has not clearly articulated the “public need” for the proposed project. The perceived “public need” of a facility like this, without any meaningful input from the community that will be substantively impacted by said development, is not a fully developed analysis. The “public need” of this type of development must not outweigh the environmental or EJ needs of an already overburdened community.
DSL is also given the broad authority to conduct an alternatives analysis for a permit such as this. The application materials do not provide any meaningful information pertaining to the local impacts that the project will have on the neighboring community, and none of the alternatives presented actually address the core issue of the project: the overburdening of a community that has already long borne the brunt of Eugene’s industrial development. DSL has the duty to conduct an alternatives analysis, and has the express authority to do so.
I/We strongly encourage the DSL to utilize its express authority to conduct a thorough review of all the materials presented for this site to ensure that it is not perpetuating a decades long cycle of environmental harm to the community of West Eugene. There are clear environmental justice considerations that every natural resource agency, including DSL, must consider in its decisionmaking, and the governing rules for a permit such as this allows DSL to require a substantive alternatives analysis. In this consideration, it must do everything in its authority to reduce the impact of this facility on surrounding environmental justice communities, including considering denying the permit if no meaningful mitigation measures or alternatives can be achieved.

Hearing Both Sides: It is important that local leaders hear both sides of the landfill expansion. Right now Republic Services enjoys preferential access to chambers of commerce and local politicians. Leaders need to hear from the local residents experiencing adverse effects from Coffin Butte Landfill and their evidence-based opposition to expansion. Ask your local leaders to hear out both sides of the debate!
Local Ownership Does Not Result in Lower Garbage Rates: Hosting the landfill has not led to cheaper garbage rates. In fact, Benton County Residents pay more for garbage than any of the neighboring counties!
Landfill Timeline: Benton County is guaranteed waste disposal services through 2040 regardless of an expansion.
Raising Garbage Rates: Republic Services has stated that denying the expansion leaves them with no choice but to raise rates. However, they cannot raise garbage rates without the approval of local governments, including both cities and counties.
Coffin Butte is EPA Noncompliant: Coffin Butte Landfill is still under investigation by the EPA for violating the Clean Air Act.
Expansion is Short-Sighted: Expanding the landfill will actually shorten the landfill’s lifespan because an expansion removes the annual cap, allowing for Republic Services to take in as much waste as they want.
Expansion Opposition is Bipartisan: Many local organizations oppose the expansion including Benton County Democrats, Benton County Republicans, Linn-Benton Green Party, League of Women Voters, Sierra Club, and Willamette Riverkeepers.

There was a hearing on February 3 on HB 4102, which changes the Oregon Department of Environmental Quality to allow private, 3rd-party entities to issue pollution permits. This will make room for corporations like Amazon and Intel to buy expedited permits and sets a dangerous precedence for environmental regulation in Oregon.
During the hearing, legislators listened to numerous testimony from support, but ended the hearing before hearing even a single opposition testimony.

HB 4102 is not a sustainable solution to permitting backlogs. Permitting delays in Oregon are mostly due to inadequate investment in state agencies. There are evidence-based solutions to permitting bottlenecks, such as investing in additional staff, modernizing systems, and providing long-term, stable funding.
Industrial emitters should not be allowed to self-regulate. HB 4102 outsources permitting to third parties, which can create conflicts of interest and begins to normalize privatization of environmental permitting in Oregon.
Allowing for a process that does not properly screen for conflicting interests can erode independent, science-based review, weaken public confidence in environmental decision-making, and create pathways for preferential treatment of well-resourced corporation.

In early September, the Eugene Planning Commission released proposed amendments to the Land Use Code that would improve coordination with Public Health Regulatory partners. A public hearing will be held Oct. 14, at 5:30 p.m. regarding these amendments.
These proposed changes, if adopted, would require that applicants have either been issued or applied for, and will likely be issued, all the appropriate environmental agencies before the City issues development permits. This was outlined as Action 1 per the June City Council decision.

Ban land uses that pose the highest risk to human health and require significant buffers between industrial uses that pose a risk to human health and sensitive uses like homes, schools, and daycare centers.

Require public hearings for new industrial developments near sensitive uses and include public health risks as a reason for permit denial.

Require no external air emissions requiring an air quality permit for industrial uses within ¼ mile of sensitive uses.
Take the Hazard and Risk Assessment seriously. Evidence shows that Bethel and Trainsong neighborhoods are disproportionately impacted by industrial pollution, and face numerous health risks. Don’t let history repeat itself: We can’t have any more facilities like J.H. Baxter putting our community members at risk.

USD Fuels public comment period is reopened September 5-19!
Last year, Beyond Toxics supported residents of Bethel’s Trainsong neighborhood in opposing a decision by the City of Eugene Planning Division that approved zone verification for a biofuels distribution site. The Planning Division reversed its decision and rescinded approval thanks to your support!
USD Clean Fuels, the biofuels company seeking the zone verification, appealed the decision to the Oregon Land Use Board of Appeals. LUBA sent the decision back to the City of Eugene, asking for further evidence. As a result, the comment period is reopening!
This is another chance to make your voice heard and to tell the City of Eugene that Trainsong residents do not want more pollution in their community!

PFAS Phase Out Bill – HB 3512

PFAS (Per- and poly-fluoroalkyl substances) or ‘forever chemicals’ are engineered to repel grease, oil, and water. These same properties allow them to accumulate in the body and the environment, where they cause harm. Added PFAS lurk in cookware, stain-resistant treatments, outdoor gear, cosmetics, food packaging, toys and dental floss.
HB 3512 phases out added PFAS in specific products to reduce harmful exposures, protect human health, and align Oregon with other states addressing these persistent and toxic chemicals.

Protect children’s health. Children are at a higher risk for toxic exposure because of their physiology, ongoing development, and behaviors such as crawling. We should continue to protect Oregon’s children from toxic chemicals and build on efforts like the Toxic Free Kids Act and the Toxic Free Cosmetic Act.
Prevent firefighter illness. Firefighters have a 9% higher risk of being diagnosed with cancer and a 14% higher risk of dying from cancer than the general U.S. population. Fire suppressing foam shouldn’t poison the firefighters using this material.
Reduce contamination. When we stop PFAS at the source, we prevent these chemicals from getting into our soil and water where they can impact the crops, pollinators, livestock and fish on which we depend.
Ensure clean drinking water. Keeping contaminants out of our water means healthy Oregonians. Ratepayers shouldn’t be stuck with the bill for ongoing water treatment costs.
Prevent toxic product dumping. As other states phase out harmful PFAS-laden products, Oregon shouldn’t become a dumping ground for companies who can’t sell these products elsewhere.

Want to make your voice heard, but don’t want to or are unable to testify orally? Submitting written testimony on OLIS is quick and easy!
Step 1: Go to the Oregon Legislative Information System (OLIS) database and search for your bill using the search bar at the top right. Be sure to use the bill number. For example, if you are searching for Toxic Free Schools, then you’d search “HB 2684.”
Step 2: Once you are on the bill page, look to the options at the top of the page. On the righthand side, click “Submit Testimony.” This option will only be available when a hearing has been scheduled.
Note: You will also see a “Register to Testify” option. That is for in-person and virtual testimony only! If you are submitting written testimony, you don’t have to register.
Step 3: Now that you are at the “Written Testimony Submission Form,” all you need to do is fill out your required information and add your testimony! Because you accessed this form through the bill’s page on OLIS, the committee and meeting date will already be filled out.
You will also need to provide your name, email, organization or city of residence, and your position on the measure. Usually, we ask that you mark your position as “Support” when submitting testimony.
Lastly, you will need to add your testimony. It’s a good idea to have it prepared ahead of time so you can just add it and submit. You can either add it directly into a text box, or upload it as a PDF. If you’re unsure what to say, check out our sample testimonies listed under each bill on this page.
Timing: Submitting written testimony affords some time flexibility. You can submit directly on OLIS up to 48 hours after the hearing begins.
For example, a hearing begins at 3:00 P.M. on the 20th. You have until 3:00 P.M. on the 22nd to submit your testimony through OLIS. After that, you must email it to your representative directly.

How to Testify In-Person or Virtually

Note: “Location When You Testify” is where you choose whether you’re testifying virtually or in person!
Step 4: Click “Submit Registration to Testify” at the bottom right of the form. Now you’re registered!
Step 5: Attend the meeting! If you registered to testify virtually, you will receive an email with all the information you need.
If you’re testifying in person, you will need to go to the Oregon State Capitol at 900 Court St NE, Salem, OR 97301. Be sure to arrive early enough to park and find your way in the building! Enter through the State Street entrance and talk to the information desk to get checked in and find the meeting room.

Step 1: Find the Bill
Go to the Oregon Legislative Information System (OLIS) and type in the bill number using the “Bill” search at the top right. Click here to access OLIS.
Step 2: Register to Testify In-Person or Virtually
On the bill’s page, scroll to the “Scheduled Events” section.
Find the public hearing date and click “Register to Testify” (registration typically opens 24 hours before the hearing).
Fill out the form and select whether you will testify in-person or virtually (via Zoom/Teams). (Can add registration link here)
After registering, you’ll receive a confirmation email with details and, if virtual, a Zoom link. Note:The registration period closes 30 minutes before the meeting begins.
You can also register to testify by calling 1-833-588-4500.
Step 3: Prepare for Your Testimony
Keep your testimony to 2-3 minutes (committee chairs may set time limits).
Make your key points clear and concise.
If testifying virtually, test your internet connection and microphone before the hearing.
Step 4: Attend the Hearing
In-person: Arrive early at the Capitol and check in with committee staff.
Virtual: Click the virtual meeting link from your confirmation email and follow instructions to join when called.
Pro Tip: Even if you can’t attend, submitting written testimony is still a powerful way to make your voice heard!

To attend a hearing in person, go to the Oregon State Capitol at 900 Court St NE, Salem, OR 97301. Be sure to arrive early to allow for time to park and to get checked in!
When you enter the Capitol building, use the doors in the center of the building on State Street. There is no entry from Court Street.
Once you’re inside, head for the information desk for directions.
